# VyroNyx BlackSky — Beta Programme Terms of Use (DRAFT v0.1)

## 1. Beta status
BlackSky is pre-release software provided under an invite-only beta programme.
It is provided "as is", without warranty of any kind. Features may change,
break, or be withdrawn without notice. Access may be suspended or revoked at
VyroNyx's discretion.

## 2. Professional responsibility (the clause that matters most)
BlackSky is a **decision-support tool for qualified process safety
professionals. It is not a substitute for a competent HAZOP study, a qualified
chairperson, or engineering judgement.**

- All outputs (worksheets, findings, recommendations, LOPA/SIL results,
  regulatory mappings) are drafts requiring review, verification, and approval
  by a qualified engineer before any use.
- The Chair Review & Sign-off step exists for this reason; sign-off constitutes
  the reviewer's professional confirmation, not VyroNyx's.
- VyroNyx accepts no liability for decisions, designs, studies, or regulatory
  submissions made using BlackSky outputs. To the maximum extent permitted by
  law, VyroNyx's total liability under the beta programme is zero (beta access
  is provided free of charge).

## 3. Your data and confidentiality
- **What we store:** account details, uploaded documents (P&IDs, worksheets),
  study data, usage logs, and feedback. Stored in our database hosted in the
  AWS Mumbai region (ap-south-1).
- **AI processing disclosure:** to generate analyses, relevant portions of your
  study data (node descriptions, instrument tags, extracted P&ID data) are sent
  to third-party AI providers (currently Groq, Cerebras, and Anthropic) under
  their API terms. We do not use providers that train models on API data per
  their published policies, but you should treat this as transmission of data
  to sub-processors.
- **Your obligations:** do not upload data you are not authorised to share.
  Where client agreements restrict disclosure, anonymise title blocks, project
  names, and client identifiers before upload. You remain responsible for
  compliance with your own confidentiality obligations.
- **Our obligations:** we will not sell your data, share it with other users,
  or use your uploaded documents for marketing. We may use anonymised,
  aggregated usage patterns and feedback to improve the platform (this is the
  purpose of the beta).
- **Deletion:** on request, we will delete your account and uploaded study
  data within 30 days.

## 4. Intellectual property
- Your uploads and your completed studies remain yours.
- The BlackSky platform, its analysis methods, knowledge structures, and all
  software remain the exclusive property of VyroNyx Private Limited. Beta
  access grants no licence beyond use of the hosted service.
- No reverse engineering, scraping, benchmarking-for-competitors, or resale
  of access.

## 5. Feedback
Feedback submitted through the platform or otherwise may be used by VyroNyx
without restriction or compensation. This is the currency of the free beta.

## 6. Term
Either party may end beta participation at any time. Clauses 2–5 survive.

## 7. Governing law
Laws of India; courts of Bengaluru, Karnataka.
